Service agreement

Terms of Service

These terms govern access to RentalHome HQ by landlords, property managers, team members, tenants, applicants, and other authorized users.Effective and last updated July 22, 2026

1. Agreement and eligibility

By accessing RentalHome HQ, you agree to these terms and the Privacy Policy. You must be at least 18 and authorized to act for the account, property, or rental record you access. If you use the service for an organization, you represent that you can bind that organization.

2. Account security and roles

You are responsible for protecting your sign-in account, keeping contact information accurate, and promptly reporting suspected unauthorized access. Workspace owners control team permissions. The RentalHome HQ superuser role is reserved for authorized platform operators and is separately logged; it is not a property-manager role.

3. Housing-provider responsibilities

Landlords and property managers are responsible for the accuracy and lawfulness of rental records, listings, application criteria, screening decisions, notices, leases, fees, deposits, maintenance responses, and communications. You must follow fair-housing, consumer-reporting, privacy, landlord-tenant, licensing, accessibility, and local notice laws. RentalHome HQ does not provide legal, tax, accounting, brokerage, or property-management advice.

4. Applications and screening

Consumer reports may be requested only for a permissible housing purpose with required certifications and consent. Screening information may not be used for an unlawful or discriminatory purpose. The housing provider—not RentalHome HQ, an AI feature, or the screening company—makes the final decision and is responsible for legally required adverse-action notices and dispute handling.

5. Leases and e-signatures

Lease drafts, templates, and AI-guided clause assembly are workflow tools, not legal advice. The guided builder may organize server-approved draft clauses from questionnaire answers, but it does not determine that a document is complete, current, enforceable, or appropriate for a particular property. State-specific templates may be enabled only after the exact version is reviewed by qualified local counsel. The housing provider must confirm all terms, disclosures, signatures, delivery requirements, and enforceability before use. When DocuSign is selected, the per-envelope service fee shown before Stripe checkout is charged before the agreement is submitted. One fee covers one submitted envelope; a replacement or separately submitted agreement may require another fee. DocuSign’s separate terms and privacy practices also apply. If payment succeeds but an envelope cannot be created, do not pay again—use the retry option or contact support.

6. Payments, subscriptions, and rent collection

Membership and tenant payment services are processed by Stripe or another disclosed provider. Provider terms also apply. RentalHome HQ does not store full card details. Subscription charges, trials, cancellations, refunds, rent settlement timing, disputes, and payouts are subject to the plan shown at checkout and provider rules. Late-fee terms may be recorded in a lease, but RentalHome HQ does not automatically charge a late fee.

7. User content and communications

You retain ownership of content you provide and grant RentalHome HQ the limited right to host, process, reproduce, and transmit it only to operate, secure, and support the service. You must have authority to upload personal data, photos, documents, and messages. Do not upload unlawful, deceptive, infringing, malicious, or unnecessarily sensitive information.

8. Acceptable use

You may not access another person’s records without authorization; bypass security or account limits; scrape, probe, reverse engineer, disrupt, or misuse the service; use automated outputs as the sole basis for a housing decision; discriminate; impersonate another person; or use the service in violation of law.

9. Third-party services

Some features depend on providers for hosting, authentication, payments, banking, screening, communications, e-signatures, listing distribution, or AI. Their availability and separate terms may affect a feature. The current categories are described on the subprocessor page.

10. Suspension and termination

We may restrict or terminate access to protect people or the service, respond to suspected misuse, enforce these terms, or comply with law. Users may request deletion from account settings or the privacy request center. Some records may be retained when legally required.

11. Service availability and disclaimers

The service is provided “as is” and “as available” to the extent permitted by law. We do not guarantee uninterrupted availability, a particular financial result, a successful rental, applicant quality, legal sufficiency of a document, screening accuracy, or provider performance. You should maintain appropriate backups and professional advice.

12. Liability and indemnity

To the maximum extent permitted by law, RentalHome HQ is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from use of the service or third-party providers. Nothing in these terms excludes liability that cannot lawfully be excluded. You agree to be responsible for claims arising from your unlawful content, housing decisions, or violation of these terms.

13. Governing law and changes

These terms are governed by Texas law, without regard to conflict-of-law rules, except where another law must apply. We may update the terms as the service changes and will post a new effective date. Continued use after an update constitutes acceptance where permitted by law.

14. Contact

Questions, legal notices, and privacy matters may be submitted through the privacy request center. A legal business name and notice address should be added before commercial launch.
